These Terms & Conditions govern access to the ChefWithPen website and cloud-based food-operations platform. By registering, purchasing a subscription or using the service, you agree to these terms.
1. About these terms
These terms form an agreement between ChefWithPen and the organisation or individual accepting them. If you use the service for an organisation, you confirm that you have authority to bind that organisation.
2. Eligibility and authority
You must be legally capable of entering a binding agreement and must use the service for lawful professional or business purposes. Registration information must be accurate, complete and kept current.
3. Accounts and security
Each user must use an authorised account and protect credentials, verification codes and devices. Your organisation is responsible for role assignments, user removal and activity performed through its accounts. Suspected compromise must be reported promptly.
4. Trials
Trial duration, included modules and usage limits are shown at registration. Trials are provided for evaluation, may be changed or ended where misuse occurs, and may not include every support or service commitment available to paid subscriptions.
5. Subscriptions and modules
ChefWithPen is module based. Access depends on the selected modules, plan, locations, users, billing cycle and other order details. Adding or removing modules may change charges and available functionality.
6. Fees, taxes and renewal
Prices presented on the website are indicative until confirmed at checkout or in a quotation. Fees, applicable taxes, billing currency, renewal terms and payment dates are stated in the accepted order. Unless stated otherwise, subscriptions renew for the selected billing period until cancelled.
7. Customer data
Your organisation retains responsibility for information entered into the service and grants ChefWithPen the limited right to host, process, transmit and back up that information as needed to provide, secure and support the service.
8. Customer responsibilities
You are responsible for data accuracy, lawful collection, permissions, internal approvals, operating procedures, qualified personnel, configuration, backups or exports made available to you, and decisions taken using service outputs.
9. Food-safety responsibility
Templates, alerts, calculations and records are operational aids. Your organisation remains responsible for hazard analysis, critical limits, validation, verification, regulatory interpretation, product disposition and the safety of food produced or supplied.
10. Acceptable use
You must not attempt unauthorised access, bypass licensing or permissions, interfere with the service, introduce malicious code, scrape protected data, reverse engineer except where law permits, infringe rights or use the platform for unlawful or unsafe activity.
11. Intellectual property
ChefWithPen and its software, interfaces, documentation, trademarks and service content are protected by intellectual-property laws. No ownership transfers to you. You may use the service only within the subscription and these terms.
12. Third-party services
Optional integrations, payment providers, email services or linked websites may be governed by separate terms and privacy practices. ChefWithPen is not responsible for third-party services outside its reasonable control.
13. Availability and changes
We work to provide a reliable service but do not promise uninterrupted availability. Maintenance, security work, legal requirements or circumstances beyond reasonable control may affect access. Features may evolve while preserving the core purpose of paid functionality.
14. Confidentiality
Each party must protect non-public information received from the other and use it only for the agreement, except where disclosure is authorised or legally required. This obligation does not apply to information lawfully public or independently developed.
15. Suspension and termination
Access may be limited or suspended for non-payment, security risk, unlawful use, material breach or threats to the service or others. Where practical, notice and an opportunity to correct the issue will be provided. Termination does not remove accrued payment obligations.
16. Disclaimers and liability
To the maximum extent permitted by law, the service is provided without warranties not expressly stated. ChefWithPen is not liable for indirect, special or consequential loss, lost profit or loss caused by inaccurate customer data, unsafe decisions or unauthorised account use. Mandatory legal rights remain unaffected.
17. Law, changes and contact
Applicable law and dispute terms may be specified in your order or agreement. We may update these terms for legal, security or service reasons and will publish the revised date. Questions may be sent to info@chefwithpen.com.
